Java is going open source we know that for a while yet http://www.sun.com/software/opensource/java/ I'm pretty much tired to see this issue of Free and Open Source Software "tied" to copyright, people may think that FOSS is without copyright. What people need to know is FOSS (through the GNU Public Licence) take the copyright concept to make sure that the software licenced under its term will always remain free (like freedom): to copy, modify, use and redistribute.
